Özet:In this study, the transformation of justice, as a policy area in the EU after 1999 has been elaborated by revealing the new regime of truth established by the securitizing politics shaped by neoliberal attempts. In this regard, policy field of justice in the Area of Freedom, Security, and Justice (AFSJ) of the EU, has been selected as the scope of analysis. The analysis is based on Foucault's conceptualization of neoliberal governmentality and contemporary literature of security. Neoliberal governmentality refers to the new form of power of which has the population as its target, political economy as its major form of knowledge, and apparatus of security as its essential technical instrument. In this sense, the individualizing and totalizing power of the neoliberal governmentality has been addressed in relation with freedom and dispositif of security; controlling, monitoring, managing, drawing optimal borders and circulation procedures. On this basis, in order to identify the new type of justice emerging in the EU the concept of “securitizing justice” has been introduced and the EU case has been analyzed accordingly. Securitizing justice is argued to be both a securitizing tool and a policy area that is implicitly being securitized at the same time in the EU. And it is concluded that justice has begun to disappear as a value in the process of transforming into a facilitating tool of the economic-juridical order and the policies of securitization.
