Özet:This master thesis looks into the role of individual application mechanism of the Constitutional Court in Turkey in the protection of human rights. Besides several significant developments in the field of human rights since the beginning of Turkey’s desire to integrate with Europe, one of the most important developments in Turkey is the individual application to the Constitutional Court, effective from late 2012. In this study, the success of individual application mechanism will be examined by comparing the decisions of the Constitutional Court with the case law of the European Court of Human Rights. The discussion will probe not only into external and internal improvements of the mechanism but also into the mechanism’s current problems and deficiencies. This thesis seeks to evaluate in short whether or not there is continuity between the decisions of the Constitutional Court and the European Court of Human Rights. It ends with a discussion on the effectiveness of the mechanism as a domestic solution towards improving human rights in Turkey in accordance with the European standards.
