This chapter argues that the history of penal law in colonial Algeria may be divided in three eras: the military conquest, the settlers’ rule, and the war of independence. To each of these eras corresponds vastly different situations of power relations and levels of effective colonial control, and consequently, different penal legal regimes. In a double movement, this research examines how both the ideological situation in the metropolis and power relations within colonial society (i.e. between settlers and colonized, but also between settlers and the State) affected the transformation of colonial penal law, and how in turn, these successive legal regimes affected social relations, the organization of consent and resistance in the colony, as well as the management of violence.
